This agreement is between myself, Zovvi (the “Artist”), and you (the “Client”).
By commissioning me, you agree to all terms listed below.Failure to comply with these Terms of Service may result in refusal of future commissions, revocation of usage rights, and/or blacklisting.I am not responsible if the Client fails to read or understand these Terms. The Client is responsible for asking for clarification if needed.

This section is a simplified summary of the main points. It does not replace the full Terms of Service. The complete Terms below will apply to all orders.
All payments must be made upfront via PayPal, Ko-fi or VGen.
The client is responsible for covering platform service fees VGen fee: 5%.
The artwork is for personal and simple comercial use only. Merchandise rights require an additional license.
Proper credit must be given. You may not claim the artwork as your own.
I retain full copyright of all commissioned work.
I may use the artwork for portfolio and promotional purposes unless a privacy fee is paid.
I may stream the drawing process unless discussed otherwise.
Only the original buyer may use the artwork. Files may not be shared or redistributed.
Refunds are only available if work has not started.
AI training, NFTs, or blockchain-related use is strictly prohibited.
If you sell or transfer ownership of the character depicted in the artwork, you can transfer the usage rights of the commissioned artwork to the new owner. However, the artwork may not be resold for a price higher than the original commission price, and I must be notified of the transfer.
I’m available on social media from Monday to Saturday, 10 am - 7 pm (GMT-3 Argentine time). A small apology in advance if I take a little time to respond.

| PERSONAL & COMMERCIAL USE_
The commission includes a exclusive, non-transferable license for:
Personal use (profile pictures, banners, decoration, etc.)
Use on monetized platforms (Twitch, YouTube, Kick, etc.)
Not included (requires additional fee):
Merchandise (prints, stickers, apparel, etc.)
Resale or redistribution
Corporate or branding use
| PROHIBITED USES_
The commissioned artwork can NOT be:
Used for AI training, datasets, or machine learning technology
Minted, sold, or associated with NFTs or blockchain technology
Edited in a way that harms my reputation
Used for hateful, discriminatory, or illegal content.
Violation of these terms will result in immediate blacklisting and potential public notice.
| PAYMENTS_
Full payment is required before work begins.
Payments are accepted via PayPal or VGen only. If the client decides to commission me through VGen, they are responsible for covering all transaction and platform fees (VGen service fee: 5%)
Orders over$300 USD can be paid in installments.
| Min $100 per part
| I am generally open to payment plans, but reserve the right to reject payment plans in particular cases - notably for first time commissioners, or priority/ rush commissions
Final files will only be delivered once full payment is completed.
Refunds are only available if work has not started.
Chargebacks or payment disputes without prior communication will result in permanent blacklisting and loss of usage rights.
Prices are non-negotiable.
Additional fees:
+100% rush fee (minimum 3-day deadline, must be confirmed before payment).
+10% complex characters (for Vtuber Model orders).
+25% very complex characters.
+20% privacy fee (artwork will not be publicly shared).
+200% merchandise rights.
| CHARACTER COMPLEXITY GUIDE_
Simple_
Characters that are mostly symmetrical, with few accessories and simple clothing with minimal layers.
No additional fee applies.
Complex_
Characters with more accessories, small details, or moderately layered clothing.
For VTuber model commissions, a +10% complexity fee applies due to the need to separate each accessory individually for rigging.
Very Complex_
Characters that are highly asymmetrical, contain many accessories or intricate details, and/or feature heavily layered clothing, textures, or complex designs.
A +25% complexity fee applies to all commission types.
The image is only intended as a guide. Every character will be evaluated individually, and complexity fees may vary depending on the design and commission type.
| REVISIONS & FEEDBACK_
Clear and detailed references must be provided before work begins. I don't do character design at the moment
Up to 3 major revisions are allowed during the sketch/WIP phase (pose, clothing, composition).
WIPs will be sent via VGen chat, discord, or agreed communication method.
If no feedback is provided in 3 days, during the revision stage, the artwork will proceed as approved.
| DEADLINES & DELIVERY_
Delivery is digital only via VGen, email or GoogleDrive.
Delivery times vary based on demand and usually range from 3 days to 2 months.
Commissions are completed in order of payment.
Rush orders must be agreed upon before payment.
If the client requires delivery by a specific date, this must be communicated in advance.
Once the product has been delivered, it is the client's responsibility to store it safely. Lost files due to negligence will not be refunded, and I can't guarantee file recovery.
| CANCELLATIONS_
I reserve the right to decline or cancel any commission
Platform fees will not be refunded.
Partial refund may be issued depending on progress
Platform/service fees are non-refundable.
I may refuse future service to any client.
The Client must never request/ submit a Paypal chargeback under any circumstances. This will be considered a violation of my Terms of Service. If a refund has been agreed on, I will transfer the funds to you per our agreement.
| INTELLECTUAL PROPERTY RIGHTS_
I, Zovvi (the “Artist”), retain full copyright and intellectual property rights over all commissioned artwork and any original designs.
Ownership of the artwork is not transferred to the Client under any circumstances.
I reserve the right to:
Display the artwork publicly.
Share it on social media.
Include it in my portfolio.
Stream or showcase the creation process (Unless a privacy agreement or fee has been applied.)
Client Rights
The Customer is granted an exclusive license to use the graphic material for personal and commercial purposes, or for any other purpose as agreed upon.
The Client NOT:
Claim the artwork as their own
Resell, redistribute, or share the files with third parties
Use the artwork for merchandise or extended commercial purposes without prior agreement
Character & Usage Transfer:
The Client may only transfer or sell the usage rights of the artwork if the character depicted in the commission is also being sold or transferred.
The artwork may not be resold for a price higher than the original commission price.
The Client must notify the Artist of the transfer.
