Terms of Service!
I. CONDENSED TERMS OF SERVICE
PLEASE READ CAREFULLY...This section is a simplified summary of the main points. It does not replace the full Terms of Service. The complete Terms below will apply to all orders.
All payments must be made upfront via PayPal or VGen.
The client is responsible for covering platform service fees (VGen fee: 5%).
The artwork is for personal and simple comercial use (Twitch, YouTube, etc.) only. Merchandise rights require an additional license.
Proper credit must be given. You may not claim the artwork as your own.
I retain full copyright of all commissioned work.
I may use the artwork for portfolio and promotional purposes unless a privacy fee is paid.
I may stream the drawing process unless discussed otherwise.
Only the original buyer may use the artwork. Files may not be shared or redistributed.
Refunds are only available if work has not started.
AI training, NFTs, or blockchain-related use is strictly prohibited.
If you sell or transfer ownership of the character depicted in the artwork, you can transfer the usage rights of the commissioned artwork to the new owner. However, the artwork may not be resold for a price higher than the original commission price, and I must be notified of the transfer.

By commissioning me you agree to the following terms and conditions expressed in this contractII. PERSONAL AND COMMERCIAL USE
The product delivered to the client is for personal use (profile pictures, banners, decoration, etc.) and commercial use (monetized streaming platforms like Twitch, YouTube, Kick, etc.)The following are NOT included and require a separate written agreement and additional fee:♥ Merchandise (prints, stickers, apparel, keychains, etc.)
♥ Resale or redistribution
♥ Commercial branding outside streaming platforms
♥ Corporate useMerchandise rights are +200% of the base price unless otherwise agreed.III. PROHIBITED USES
The commissioned artwork can NOT be:♥ Used for AI training, datasets, or machine learning technology
♥ Minted, sold, or associated with NFTs or blockchain technology
♥ Edited in a way that harms my reputation
♥ Used for hateful, discriminatory, or illegal content.Violation of these terms will result in immediate blacklisting and potential public notice.IV. PAYMENTS
Full payment is required before work begins.Payments are accepted via PayPal or VGen only. If the client decides to commission me through VGen, they are responsible for covering all transaction and platform fees (VGen service fee: 5%).Orders over $300 USD can be paid in installments.Final files will only be delivered once full payment is completed.Refunds are only available if work has not started.Chargebacks or payment disputes without prior communication will result in permanent blacklisting and loss of usage rights.Prices are non-negotiable.Additional fees:♥ +100% rush fee (minimum 3-day deadline, must be confirmed before payment)
♥ +25% hyper-detailed characters
♥ +20% privacy fee (artwork will not be publicly shared)
♥ +200% merchandise rightsV. REVISIONS AND FEEDBACK
Up to 3 major revisions are allowed during the sketch/WIP phase (pose, clothing, composition).Clear and detailed references must be provided before work begins.WIPs will be sent via VGen chat, email, or agreed communication method.If no feedback is provided during the revision stage, the artwork will proceed as approved.After completion:♥ Only minor corrections (such as color adjustments or small fixes) will be made if the mistake is mine.
♥ Additional changes after final approval will require an extra fee.
♥ I am not responsible for issues caused by unclear references or missing information.VI. DEADLINES AND DELIVERY
Delivery is digital only via VGen or email.Delivery times vary based on demand and usually range from 3 days to 2 months. Commissions are completed in the order received.Commissions are completed in order of payment.Rush orders must be agreed upon before payment.If the client requires delivery by a specific date, this must be communicated in advance.
Once the product has been delivered, it is the client's responsibility to store it safely. Lost files due to negligence will not be refunded, and I can't guarantee file recovery.VII. CANCELLATIONS
II reserve the right to:
Decline or cancel any commission with a full refund before work begins.Cancel a commission due to inappropriate or disrespectful behavior.If cancellation occurs after work has started, refunds will be partial and based on the amount of work completed.I also reserve the right to refuse future service to any client.VIII. INTELLECTUAL PROPERTY RIGHTS
I, Zovvi, retain full copyright over all commissioned artwork.
The client is granted non-transferable rights to use the artwork on their personal Twitch, YouTube, Discord, or social media platforms.
You may not claim the artwork as your own. Copyright ownership is not transferred upon payment.
The commissioned work is not intended for merchandise or resale. If you wish to acquire a merchandise license, please contact me.By commissioning me, you agree to all the terms and conditions listed above.
